If you were a customer of 23andMe between May 1, 2023 and October 1, 2023, resided in Canada during that period, and received notice that your personal information was compromised in the Cyber Security Incident, you may be eligible for compensation.
This Settlement provides compensation for documented, unreimbursed out-of-pocket expenses incurred as a direct result of the Cyber Security Incident (up to CA$2,500), as well as a pro rata share of the available settlement funds for ordinary claims, without the need to provide further proof.
Settlement Status
On March 16, 2026, the Canadian Court recognized the Order of the U.S. Chapter 11 Insolvency Court, dated February 17, 2026. The claims period began on March 27, 2026 and will end on June 25, 2026 at 11:59 PM Pacific Time.
Eligibility
The Canadian Settlement covers any individual who:
- was a customer of 23andMe at any time between May 1, 2023 through October 1, 2023 (the "Cyber Security Incident Period");
- resided in Canada during the Cyber Security Incident Period;
- received a notice from 23andMe notifying the customer that their personal information was compromised in the Cyber Security Incident; and
- did not opt out of the Canadian Data Breach Settlement in accordance with the Court-approved procedure.
Settlement Benefits
The gross settlement amount is US$3.25 million (approximately C$4.49 million). Eligible Canadian Claimants may receive compensation via two types of claims:
Eligible Extraordinary Claims
- Reimbursement of up to CAD$2,500 for documented, unreimbursed, out-of-pocket expenses incurred between October 1, 2023 and March 31, 2024 as a direct result of the Cyber Security Incident, including:
- Costs associated with the purchase of a physical security or monitoring system
- Costs associated with seeking professional mental health counseling or treatment
- Any other documented expense incurred as a direct result of the Cyber Security Incident
Eligible Ordinary Claims
- A pro-rated share requiring no further information or documentation. Each Canadian Eligible Claimant who completes and submits a valid Canadian Claim Form will be automatically considered for receiving compensation.
All payments will be issued in Canadian currency.
